Using the the VRBO (Vacation Rental By Owner), AirBnB, or other online reservation and payment system, Saphhuron Holdings LLC (hereafter called Owners) agrees to lease managed properties,, for a period and amount documented in the online reservation and payment system. The parties agree that dates, payments, and details will be specified and recorded by the online reservation and payment system.
The parties further covenant and agree that:
CANCELLATIONS: Guests who cancel at least 30 days before check-in will get back 100% of the amount they've paid. If they cancel between 14 and 30 days before check-in, they'll get back 50%. Otherwise, they won't receive a refund.
LIMITED OCCUPANCY: Occupancy is limited to the amount specified in the reservation with a maximum of 9. If the Owner concludes that this policy has been breached, the Owner reserves the right to expel the entire party with no refund.
NON-DISTURBANCE CLAUSE: Renter and their guests shall not disturb, annoy, endanger (fireworks), or create inconvenience for neighbors nor use the premises for any unlawful purposes. A disturbance caused by Renter or Renter's occupants or invitees that results in any police action, complaints from neighbors is considered sufficient cause for immediate termination of this Vacation Rental agreement, immediate eviction, and forfeiture of all monies paid as permitted by law. The Renter will be responsible for any fine and/or violation that is imposed on the Owner due to the Renter's negligence.
CARE OF PREMISES/DAMAGES: NO PETS ALLOWED. NO SMOKING PERMITTED IN HOUSE. Automatic eviction plus fee of $300 and rent if violated. Renter agrees to pay the Owner for any damages to furnishings or household items that occur as a result of Renter’s occupancy. This will include payment of any additional cleaning charges over $100.00 incurred due to Renter’s occupancy.
OWNERS RIGHTS: Renter agrees that if the conditions and limitations set forth herein are not met, Owner shall have the right to cancel this agreement and may enter the Property, either by statutory proceedings or by force, to inspect the Property and ensure that Renter has vacated the Property. All monies paid by Renter shall be forfeited as liquidated damages.
INDEMNITY CLAUSE: Renter hereby agrees to Indemnify and hold the Owner harmless from any and all claims, including those of third parties, arising out of or in any way related to Renter’s use of Property or the items of personal property provided therein. Renter assumes all risk of injury or other losses relating to any recreational activities, including the use of the recreational equipment on the Property, and will hold Owner harmless with respect thereto.
ACTS OF NATURE: Owner/Agent does not accept any liability for loss, damage or injury to persons or their personal property due to forces that are beyond the Owner/ Agent's control such as but not limited to poor weather, bad road conditions, natural disasters, power outages, mandatory evacuations, construction, and/or "Acts of God." Owner/Agent is not responsible for any inconveniences that may occur to prevent the use of amenities such as but not limited to television, and internet. REFUNDS WILL NOT BE GIVEN DUE TO POOR WEATHER CONDITIONS OR OTHER OCCURRENCES SUCH AS THOSE LISTED HEREIN.
NO SUBLETTING: Renter may not sublet or assign this lease for all or any part of the premises without the prior written consent of the Owner.
REPAIRS AND MAINTENANCE: The Property is rented with the Owner’s furniture and household furnishings. The owner shall not be responsible for providing additional furnishings or equipment not presently available in the Property. Renter must keep the Vacation Rental premises clean and sanitary at all times and remove all rubbish, garbage and other waste, in a clean, tidy and sanitary manner. Renter shall properly use and operate all electrical, cooking and plumbing fixtures and to keep them clean and sanitary. Renter will report any maintenance issues immediately to the Owner. The owner will make every effort to repair and/or replace any equipment that is not working properly but cannot guarantee that all equipment is in good operating order at all times and no rate adjustments or refund will be made for equipment or appliance failures. If any repair is caused by the negligence of the Renter and/or Renter's guests, occupants and/or invitees, Renter will have full responsibility for the cost of the repair and/or replacement that may be required.
PETS: No pets are permitted without written permission of the Owner/Agent except for service animals according to federal, state and local regulations. Owners of service animals may be asked to attest to their disability status and the work or task the service animal has been trained to perform. We remind guests that misrepresentation of the need for a service animal is a misdemeanor in California.
SECURITY: Renter has inspected and acknowledges that all door and window locks, fire extinguishers, security alarms systems and/or carbon monoxide detectors are in sound working order. Renter further understands and acknowledges that although Owner/ Agent makes every effort to make the Vacation Rental premises safe and secure, this in no way creates a promise of security.
RIGHT OF ENTRY: Owner/Agent reserves the right to gain entrance to the premises with advance notice via phone call, text, or email message to inspect the Vacation Rental Premises, to respond to an emergency, or to make repairs. Renter shall not prevent the Owner/Agent from gaining entrance under these circumstances. Owner/Agent will not infringe upon the peaceful enjoyment of the Renter(s) and will exercise reasonable notice before entering.
RESTRICTED AREAS: Tenant acknowledges that Landlord may have "owners" closets which are locked and certain areas of property such as closets, barns, or cabinets which owners property are stored in and which are not accessible to Tenant under this agreement. The barn and adjoining structures are strictly off limits.
PARKING: Parking is available in the flat section of the driveway and in the garage. No vehicles are permitted off the pavement sections of the property.
GUEST VERIFICATION: I give permission to SafelyStay, Inc., to verify my identity, and check criminal databases in order to confirm my reservation. HOUSE RULES:
Take care of the furnishings. You are responsible for damages.
All furniture should remain in its original location.
Quiet hours observed after 9:00PM in respect of the neighbors.
All windows and doors must remain closed during inclement weather and be closed and before you leave.
Remove and dispose of all food items from the refrigerator and pantry/cabinet, take trash to the dumpster, remove sheets and all dirty towels and place them in the laundry area, and place dishes, utensils, etc. in the dishwasher and turn it on when you depart.
No unregistered guests allowed.
There is no smoking, pets, or illegal substances allowed on the premises.
Do not tamper with smoke detectors or security devices.
Renter acknowledges that they have read, accepted, and agreed to the terms set forth, and assumes the responsibility for the obligations set forth herein.
